Abstract
Violence in the name of religion has never completely disappeared from discourse on religious life in Indonesia. The spirit of the new religiosity which is teeming with extreme, unyielding and rigid views, haunts the Republic, the majority of whose inhabitants are Muslim. This article analyses the reasoning behind contemporary religiosity in Indonesia and then offers humanist religiosity as a way of reconstructing thinking and views that are clumsy and textual. The jurisprudence of religious moderation offers an alternative reinforcing narrative in seeking the jurisprudential beauty containing the values of tolerant humanism. Moderate jurisprudence constructs the text, understands the context, and optimises legal reasoning through the application of independent reasoning (ijtihad), renewal and reform (tajdid). This articles stresses that Islamic law develops within the framework of diversity, is dynamic and changes within the framework of responding to the challenges of globalisation and modernisation.
