Abstract

The concept of the rule of law was taken into account by the founding fathers of Indonesia, and it is explicitly outlined in the constitution that has been and is presently in effect in the country. The rule of law is a state that ensures the integrity and justice of the law, and no authority is exempt from accountability. Law is idealized as the dominant force in the dynamics of state life, above politics or economics. The rule of law encompasses many principles, including the supremacy of law, equality before the law, due process of law, limitation of power, independent state institutions, free and impartial judiciary, state administrative court, constitutional court, protection of human rights, being democratic (democratische rechtsstaat), a means to realize the goals of the state (welfare rechtsstaat), transparency and social control, and belief in one Almighty God.
