Abstract

Misuse of residence permits by foreign nationals can have a negative impact on life patterns and socio-cultural order, which in turn can affect the maintenance of national security and resilience. The purpose of this study is to analyze how the residence permit arrangement of foreign nationals based on Law No. 6 of 2011 concerning Immigration, to analyze how the authority of the Immigration Office for the misuse of residence permits for foreign nationals based on Law No. 6 of 2011 concerning Immigration, to analyze the obstacles faced by the Immigration Office if there are foreign nationals who abuse their residence permits. This study uses an empirical juridical method using a legislative approach, a legal sociology approach, and a conceptual approach. As a result of the research, first, there are rules related to foreigners' residence permits, namely Law Number 6 of 2011 concerning Immigration. Second, the Immigration Office has the authority to take action against foreign nationals who violate immigration laws and abuse of high permits. The regulation of residence permits as stipulated in Law Number 6 of 2011 is to carry out Immigration Administrative Actions (TAK) to foreign nationals who abuse residence permits in Indonesian territory in the form of Deportation.
