Abstract
This study aims to analyze legal protection for creditors in cases of transfer of fiduciary collateral objects by debtors without the creditor’s consent. Fiduciary collateral, as regulated in Law Number 42 of 1999 concerning Fiduciary Collateral, provides property rights to creditors over collateralized goods, so that the collateral object remains the property of the debtor, but the right of execution is in the hands of the creditor. Problems arise when debtors unilaterally transfer collateral objects to third parties without the creditor’s consent, which can result in losses for creditors. This study also highlights the importance of fiduciary collateral certificates as legal protection that provides exclusive rights to creditors in cases of illegal transfer of fiduciary collateral. The results of the study indicate that the transfer of fiduciary collateral objects without the creditor’s consent is considered an unlawful act, which can result in default and allow creditors to execute fiduciary collateral even though the object has been transferred to a third party. Legal protection for creditors in cases of transfer of fiduciary collateral objects still has weaknesses, especially in terms of supervision and law enforcement.
